{"id":79835,"date":"2026-02-18T04:08:38","date_gmt":"2026-02-18T04:08:38","guid":{"rendered":"https:\/\/healthprovidersdb.com\/wp\/?p=79835"},"modified":"2026-03-22T20:30:20","modified_gmt":"2026-03-22T20:30:20","slug":"who-needs-to-be-screened","status":"publish","type":"post","link":"https:\/\/healthprovidersdb.com\/wp\/who-needs-to-be-screened\/","title":{"rendered":"Who should be screened for OIG Exclusions?"},"content":{"rendered":"\n<p>To avoid <a href=\"https:\/\/www.ecfr.gov\/current\/title-42\/chapter-IV\/subchapter-A\/part-402\">Civil Monetary Penalties<\/a>, healthcare organizations must screen new hires and regularly monitor current employees and vendors against <a href=\"https:\/\/healthprovidersdb.com\/wp\/oig-exclusion-list\/\" type=\"page\" id=\"6324\">OIG Exclusions<\/a>, <a href=\"https:\/\/healthprovidersdb.com\/wp\/sam-exclusions-list\/\">SAM.gov<\/a>, and <a href=\"https:\/\/healthprovidersdb.com\/wp\/state-medicaid-exclusions-list\/\">State Medicare Provider Termination Lists<\/a>. But who needs to be screened sometimes is not so clear.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Healthcare Providers are responsible for ensuring <span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">compliance with the exclusion statutes for&nbsp;anyone who provides<\/span> items or services, directly or indirectly, in whole or in part, that are payable by federal healthcare programs, including Medicare, Medicaid, TRICARE, and the Children&#8217;s Health Insurance Program (CHIP).<\/p>\n\n\n\n<p>This is not limited to direct billers. Services identified by the OIG include transportation service providers, administrative services, medical equipment suppliers, billers and coders, and pharmacists.<\/p>\n\n\n\n<p>Providers are liable for overpayments made for any items or services provided by any excluded person for which the provider received reimbursement from federal healthcare programs. Additionally, the provider may face <a href=\"https:\/\/www.ecfr.gov\/current\/title-42\/chapter-IV\/subchapter-A\/part-402\">Civil Monetary Penalties<\/a> (CMP) if they fail to ensure that proper exclusion screening has been conducted.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-key-individuals-and-entities-to-screen\"><span class=\"ez-toc-section\" id=\"Key_Individuals_and_Entities_to_Screen\"><\/span>Key Individuals and Entities to Screen<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Employees:<\/strong>&nbsp;All staff, including administrators, directors, managers, billing, and support staff, not just those with direct patient care.<\/li>\n\n\n\n<li><strong>Contractors and Vendors:<\/strong>&nbsp;Third-party providers, Medical Equipment Managers, IT solutions, Food Service Workers, Security, Staffing agencies, Ambulance and Other Transportation Service Providers.<\/li>\n\n\n\n<li><strong>Medical Professionals:<\/strong>&nbsp;Physicians, nurses, pharmacists, and lab technicians.<\/li>\n\n\n\n<li><strong>Leadership:<\/strong>&nbsp;Board members, officers, and owners.<\/li>\n\n\n\n<li><strong>Others:<\/strong>&nbsp;Volunteers, interns, and students in training.<\/li>\n<\/ul>\n\n\n\n<p>When in doubt as to who should be screened, providers may want to consider that the OIG has stated that civil penalty liability is \u201c<strong>greatest for those persons that provide items or services integral to the provision of patient care.<\/strong>\u201d<\/p>\n\n\n\n<p>Even if someone isn&#8217;t directly providing care, they might still be involved in billing, patient records, or managing payments for federal programs. These roles are critical, and OIG exclusion checks should apply here.<\/p>\n\n\n\n<p>Think of anyone supplying medical equipment, pharmaceuticals, or services to a healthcare organization. Just because someone isn&#8217;t a full-time employee doesn&#8217;t mean they shouldn&#8217;t be checked. They must pass an OIG background check if they provide goods or services involving federal funds.<\/p>\n\n\n\n<p>Volunteers can be involved in patient care or sensitive healthcare operations in specific settings. While not always required, screening volunteers can help ensure the organization maintains compliance with federal regulations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-screening-contractors-and-vendors\"><span class=\"ez-toc-section\" id=\"Screening_Contractors_and_Vendors\"><\/span>Screening Contractors and Vendors<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In the HHS-OIG&nbsp;<a href=\"https:\/\/oig.hhs.gov\/exclusions\/files\/sab-05092013.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">2013 Special Advisory<\/a>, the OIG suggests two options when it comes to screening contractors and vendors:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>(1) providers themselves may screen their contractors\u2019 or vendors\u2019 employees,&nbsp;or<\/li>\n\n\n\n<li>(2) A provider may&nbsp;rely on a contractor\u2019s or vendor\u2019s certification that the contractor or vendor is conducting screening of its own employees and contractors. <\/li>\n<\/ul>\n\n\n\n<p>OIG recommends that providers verify that their contractors are conducting screening on their behalf.
