You can use it as often as you like.<\/p>\n\n\n\n<p>The questionnaire will help you determine whether an organization or individual is a covered entity under the Health Insurance Portability and Accountability Act (<a href=\"https:\/\/aspe.hhs.gov\/report\/health-insurance-portability-and-accountability-act-1996\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">HIPAA<\/a>).<\/p>\n\n\n\n<center>\n<object data=\"https:\/\/healthprovidersdb.com\/app\/Questionnaires\/CoveredEntityDecisionQuestionnaire\/Play?embed=true\" data-autosize=\"1\" style=\"margin: 0px; padding: 0px; border: none; display: block; height: 100vh; min-height: 400px; min-width: 80%; overflow: hidden;\" scrolling=\"no\"><\/object>\n<\/center>\n\n\n\n<p>The Centers for Medicare &amp; Medicaid Services (CMS) developed a Covered Entity Decision Tool as an interactive <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/HIPAA-ACA\/Downloads\/CoveredEntitiesChart20160617.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">PDF<\/a> document. This questionnaire follows the documented process flow but is more user-friendly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Covered Entity?<\/h2>\n\n\n\n<p>Individuals and organizations that must comply with HIPAA are called Covered Entities, which include Health Plans, Clearinghouses, and certain Healthcare Providers.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Health Plans<\/h3>\n\n\n\n<p>For&nbsp;HIPAA&nbsp;purposes, health plans include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Health insurance companies<\/li>\n\n\n\n<li>HMOs, or health maintenance organizations<\/li>\n\n\n\n<li>Employer-sponsored health plans<\/li>\n\n\n\n<li>Government programs that pay for health care, like Medicare, Medicaid, and military and veterans\u2019 health programs<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Clearinghouses<\/h3>\n\n\n\n<p>Clearinghouses include organizations that process nonstandard health information to conform to&nbsp;data content or format standards, or vice versa, on behalf of other organizations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Providers<\/h3>\n\n\n\n<p>Providers who electronically submit HIPAA&nbsp;<a href=\"https:\/\/www.cms.gov\/priorities\/key-initiatives\/burden-reduction\/administrative-simplification\/transactions\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">transactions<\/a>, like claims, are covered. These providers include, but are not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Doctors<\/li>\n\n\n\n<li>Clinics<\/li>\n\n\n\n<li>Psychologists<\/li>\n\n\n\n<li>Dentists<\/li>\n\n\n\n<li>Chiropractors<\/li>\n\n\n\n<li>Nursing homes<\/li>\n\n\n\n<li>Pharmacies<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">About Business Associates<\/h3>\n\n\n\n<p>Suppose a covered entity engages a&nbsp;<a href=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/privacy\/guidance\/business-associates\/index.html\" data-type=\"link\" data-id=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/privacy\/guidance\/business-associates\/index.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">business associate<\/a>&nbsp;to help carry out its healthcare activities and functions. In that case, the covered entity must have a written business associate contract or other arrangement with the business associate that:<strong>&nbsp;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Establishes specifically what the business associate has been engaged to do<\/li>\n\n\n\n<li>Requires the business associate to comply with HIPAA<\/li>\n<\/ul>\n\n\n\n<p>Examples of business associates include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Third-party administrator that assists a health plan with claims processing<\/li>\n\n\n\n<li>A consultant who performs utilization reviews for a hospital<\/li>\n\n\n\n<li>Healthcare clearinghouse that translates a claim from a nonstandard format into a standard transaction on behalf of a healthcare provider and forwards the processed transaction to a payer<\/li>\n\n\n\n<li>Independent medical transcriptionist that provides transcription services to a physician<\/li>\n<\/ul>\n\n\n\n<p>Also, a covered healthcare provider, health plan, or healthcare clearinghouse can be a business associate of another covered entity.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Exceptions<\/h3>\n\n\n\n<p>An organization may request an exception from using a standard transaction from the Secretary to test a proposed modification to that standard.
