New York Exclusion Screening Requirements

The HHS Office of Inspector General (HHS-OIG) has the authority to exclude individuals and entities from participation in Medicare, Medicaid, Children’s Health Insurance Program (CHIP), and all Federal health care programs as defined in section 1128B(f) of the Social Security Act (the Act).

Federal regulations require State Plans for Medical Assistance establish and implement statewide controls to safeguard against unnecessary or inappropriate utilization of healthcare services and payments.

The New York State Office of the Medicaid Inspector General (OMIG) is responsible for identifying, preventing, and prosecuting fraud, abuse, and misuse in the public healthcare programs.

To ensure existing employees or contractors, and new hires have not been excluded from participation in the Medicaid program, providers participating or applying to participate in the Medicaid program must search the following exclusion lists monthly:

  • NYS Medicaid Exclusion List
  • Health & Human Services (HHS) Office of Inspector General (OIG) List of Excluded Individuals and Entities (LEIE)
  • General Services Administration (GSA) System for Award Management (SAM)

Excluded individuals or entities, even if they are not on the State Exclusion List, are excluded from participating in and are not allowed to receive reimbursement for providing Medicare, Medicaid, or CHIP services in any capacity.
